Defense of Consumers & Fair Business Practices
It is becoming more and more common for companies to receive claims from consumers. These have greatly increased lately due to the great number of public entities appointed to receive them and to the new regulations.
We act on behalf companies which are requested to comply with the statutory provisions in force as a result of claims filed by consumers, attending conciliation hearings, answering charges, appealing fines, and resorting to court.
We also advise clients regarding compliance with all aspects of the Defense of Consumers Regulations, by analyzing whether the commercial activity complies with all the standards requested by law, revising if the contracts, publicity, packaging and any other notice to the consumer comply with the legal provisions in force.
We provide assistance to clients who organize consumer-aimed promotions and contests with prizes, by representing products or services’ providers and advertising agencies in order to obtain authorizations from the National Lottery and provincial bodies, drafting the terms and conditions, the notices to consumers, submitting prizes and rendering legal assistance during all the promotion among other services.
We also participate in regional contests working together with correspondent lawyers in Latin America in order to obtain the corresponding authorizations during the development of a contest.
We provide ongoing counsel as regards Fair Business Practices in case of presentations before the control entities and we assist clients regarding compliance with the statutory provisions in force.
